Terms of Service

The agreement between you and timesheet-tech covering accounts, plans, payment, acceptable use, your data and liability.

These Terms of Service ("Terms") are an agreement between you and timesheet-tech ("we", "us", "our") covering your use of the timesheet-tech website and timesheet application (the "Service"). By creating an account or using the Service you accept these Terms. If you are accepting on behalf of a business, you confirm you are authorised to bind that business, and "you" means that business.

1. The Service

The Service lets workers record the hours they work, lets managers review and approve those hours, and produces reports and invoices from the approved result. We may add, change or remove features over time. Where a change materially reduces the functionality of a paid plan, we will give reasonable notice first.

2. Accounts

  • You must give accurate registration details and keep them up to date.
  • You are responsible for keeping your credentials secure and for everything done under your account. Tell us promptly at hello@example.com if you suspect unauthorised access.
  • Accounts are approved before they gain full access. We may decline or revoke approval where an account appears to breach these Terms.
  • A business account has administrators who can invite users, view and edit their timesheets, and remove their access. If you were invited by an employer, your access is governed by their account.

3. Plans, trials and payment

  • Paid plans are billed per employee, per month, in advance, at the prices shown on our pricing page. The Starter plan is free for up to three people.
  • Every plan starts with a 14-day free trial, and no card is required to begin the trial.
  • Subscriptions renew automatically each billing period until cancelled. You can cancel at any time from your account, and the cancellation takes effect at the end of the period you have paid for.
  • Fees are exclusive of taxes unless stated otherwise, and you are responsible for any taxes that apply to your purchase.
  • Except where the law requires otherwise, payments are non-refundable and we do not refund partial periods.
  • We may change prices with at least 30 days' notice. The new price applies from your next billing period, and you may cancel before it takes effect.
  • If a payment fails we may suspend access to paid features until the balance is settled.

4. Acceptable use

You agree not to:

  • Break the law, infringe anyone's rights, or use the Service to harass or defraud others.
  • Upload malware, or anything unlawful, abusive or deliberately misleading.
  • Probe, scan, overload or interfere with the Service or the infrastructure behind it, or attempt to gain access to accounts or data that are not yours.
  • Reverse engineer, decompile or copy the Service, except to the extent the law permits.
  • Resell, sublicense or rent the Service without our written permission.
  • Use automated means to scrape the Service beyond what our robots.txt allows.
  • Falsify timesheet records, or use the Service to misrepresent hours worked.

5. Your data

You keep all rights in the data you put into the Service. You grant us a licence to host, process, transmit, back up and display that data solely to provide and support the Service. You are responsible for having the right to submit that data, including any personal information about your workers, and for meeting your own employment and record-keeping obligations.

We handle personal information as described in our Privacy Policy. Where we process worker data on behalf of a business account, that business is the controller of the data and we are its processor.

6. Export and deletion

You can export your timesheet data at any time while your account is active. After termination we keep your data for a limited window so you can retrieve it, then delete or anonymise it in line with our Privacy Policy. Export before you close the account: we cannot guarantee recovery afterwards.

7. Our intellectual property

The Service, including its software, design, branding and documentation, belongs to us and our licensors. These Terms grant you a limited, non-exclusive, non-transferable, revocable right to use the Service while your account is in good standing, and nothing more.

8. Feedback

If you send us suggestions, we may use them without restriction and without owing you anything. We will not identify you as their source without your permission.

9. Third-party services

The Service integrates with third-party services such as payment processors, email delivery and cloud storage. Your use of those services is governed by their own terms, and we are not responsible for their acts or omissions.

10. Availability

We aim to keep the Service available but do not promise uninterrupted access. We may take it down for planned maintenance, and will give notice where we reasonably can. We may also suspend access without notice where necessary to protect the Service or its users.

11. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if your payments fail, or if we are required to by law. We may also discontinue the Service as a whole, in which case we will give reasonable notice and refund any fees covering a period after the shutdown.

12. Disclaimer

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be error-free, or that the records it produces will satisfy any particular legal, payroll or tax requirement. You remain responsible for checking the hours and figures you rely on.

13. Limitation of liability

To the fullest extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, goodwill or data. Our total liability arising out of or relating to the Service is limited to the fees you paid us in the twelve months before the event giving rise to the claim, or one hundred dollars if you paid us nothing. Nothing in these Terms excludes liability that cannot lawfully be excluded.

14. Indemnity

You will indemnify us against claims, losses and reasonable legal costs arising from your data, your use of the Service, or your breach of these Terms, except to the extent they are caused by us.

15. Changes to these Terms

We may update these Terms. The "last updated" date at the top of this page reflects the current version, and we will give notice of material changes by email or an in-app notice before they take effect. Continuing to use the Service after that means you accept the new Terms.

16. Governing law

These Terms are governed by the laws of the jurisdiction in which timesheet-tech is established, and the courts of that jurisdiction have exclusive jurisdiction over any dispute, without regard to conflict-of-law rules. Nothing here removes any consumer protection you have under the mandatory law of the country you live in.

17. General

  • These Terms and the Privacy Policy are the entire agreement between us about the Service, and replace any earlier understanding.
  • If a provision is held unenforceable, the rest stays in force.
  • Not enforcing a provision is not a waiver of it.
  • You may not assign these Terms without our consent. We may assign them to a successor in a merger, acquisition or sale of assets.
  • Neither party is liable for delays caused by events beyond its reasonable control.

18. Contact us

Questions about these Terms can be sent to hello@example.com or through our contact form.
